      What DATA is needed from our OLDER Generation?

      1. The actual address of the claimed property in Poland or another East European country (City / Street / Number)
      2. Historic Owner’s full name.
      3. Claimant’s relationship to the old property owner.
      4. Claimed Property Description.
      5. Dates during which claimed property was occupied by old owner with particular emphasis of date of abandonment.

      Is having the address of the property enough?

      Absolutely not. We will need to verify the Registered Land and Mortgage identification number of the claimed property. It is essentially important to verify claimant's legal rights to each claim. without such detailed information and proofs - case should be closed.

      OK, the property has been found and all registration numbers identified. What's next?

      Upon identification of the property it is essential to analyze its legal status. During such analysis it is essential to:
      1. Order documents from the Land and Mortgage (L&M) archives
      2. Check the registered documentation
      3. Check the legal registration of all previous owners of the property
      4. Realize what is the of the property value 
      5. Provide the client with a report which includes a summarized legal opinion

      What should be expected as a result of such a legal opinion?

      Whether it is worth continuing with the process or not.

      Can you provide us with an example of a case which you would not proceed?

      YES. In case original owner name was Morris Greenbaum. If we find that the Greenbaum's sold the property to Mr. Kowalski and the Kowalski family is registered as owners for more than 25 years – there will be a final decision not to proceed with the case. 

      Which documentation or data will we need in order to start the inheritance procedure in Poland?

      Inheritance procedures must be conducted in the same country where the claimed property is situated, and a major factor is defining what are the necessary documents. Process may be simplified if client can show that inheritance procedures were done for family members in Israel or in any other country of residency. We will need to present such inheritance procedure documents at Polish court and to have it converted according to the Polish legal system. The following documents should be considered as the minimum required:
      Birth certificates / Death certificates / Marriage certificates.
      Legacy's purpose is to prove in court the linkage between the claimant and the original registered owner. It should be clear that if such linkage cannot be proved, it will be decided to close the case.

      Once we have successfully completed the inheritance procedure, what is next? Is the claimant now the owner?

      The next step is to apply to the court and ask for permission to enter a claimant who has now become an heir into the registered L&M document.
      Following successful registration, there are two options. The new owner can now either start collecting rent or he can sell the property.

      What is recommended?

      In case client lives in Poland or in another nearby country we would recommend according to property location - if to keep the ownership and manage it or sell. For clients who live far away from Poland and do not plan frequent visits to this country, it is absolutely  recommended to  sell.  

      What is the time span for the procedures described?

      Phase 1 – search and analysis – 3-4 months
      Phase 2 – inheritance procedure – up to 24 months
      Phase 3 – Property registration in Land and Mortgage – 12-24 months
      Phase 4 – Selling – always depends on the market situation
